Hello Officers! Quick question. California has several different subsections of trespassing. If you are stealing oysters it is one crime, if you are cow tipping it is another charge, etc. What right to business owners have to say to someone on their property that they are not allowed to come back.
I did some research before asking the question, and it said that after an arrest law enforcement officers can tell the suspect he cannot return to the property for 1 year if it was an infraction, 2 years if it was a misdemeanor, 3 years if it was a felony, or 5 years if it was a violent felony.
Is there any truth to this?
I would think a private person could tell the local drunk he is no longer allowed in his business and if he returns couldn't the business owner place him under citizens arrest?
