Michael N. Penn was wanted by police for allegedly stealing a Samsung tablet and one other item from a Delaware Verizon store in June.
Investigators were called into the Verizon store to view the store's surveillance video. "They were able to identify Penn as the man who stole a Samsung tablet and another item from the store last month," Lt. Adam Brams said.
On Tuesday, police were looking for Penn and they spotted the suspect out walking around with his children, 8-month-old son and 5-year-old daughter. Police stopped to pick him up and inform him about the shoplifting warrant.
While police were questioning the suspect over the alleged stolen items Penn was holding his 8-month-old son. When asked to put the child down, investigators said Penn refused. He eventually would put the child down on the floor. Police observed him allegedly putting something down his son's diaper at the same time.
Penn turned his back away from the officers and "began to cover his right hand and shove an unknown item into his youngest child's front pants area," police report said.
Officers took Penn's arms and pulled them around his back to arrest him. Officers then found 16 baggies of heroin that Penn allegedly put down the sons diaper.
Penn said "he was sorry and that he was scared," which was why he made attempt to hide the drugs in his child's diaper, according to police record.
Michael N. Penn is charged with shoplifting, three counts of endangering the welfare of a child, resisting arrest, heroin possession, possession of a controlled substance and possession of drug paraphernalia.
The suspect has been released on $4,500 unsecured bond pending a court hearing.

Michael is taking advantage of his children to commit crime. The five years old daughter is old enough to notice when her father steals; he is actually teaching her that stealing is right. He adds insult to injury by being in possession of drugs when he is with his kids. I hope that he learns from his mistakes.
